Night of 2/13/04 Cont.

When I was first put into the holding cell area I was placed against a wall and searched again. While there in the hallway I and another prisoner were told to back up and stand against a wall. As we stood against the wall there came from the left and around a corner, a prisoner with his Jean's around his ankle's, his hands cuffed behind him, and his boxer's half off trying to walk down the hall with two officers just behind him yelling at him. He got about 15 feet down the hall when I heard a thud and when I looked over he was on the floor with the knee of the smaller officer in his back pinning him to the floor and the other very large officer bent over punching him. I looked straight ahead at that point at the wall across the hall from me. Two other officers came down the hall and joined the others. The little fellow next to me on my left (called Angel) stepped out a little to see around me and started saying "Hey, that is not right what you are doing to him". This was a mistake. The large officer "D. Vola" came back to where he was standing and slammed him back against the wall, telling him that it was none of his business, that he would do anything he wanted. This was his house. Then he went strutting back down the hall yelling "THIS IS MY HOUSE AND I DO WHAT I WANT IN MY HOUSE" several times. The officers then drug the guy into an open holding cell and I could only hear thumps and screams and moans. The entire time he was being yelled and screamed at, being call a Bitch, Punk, Whore, being told he was going to be put in with the butt F--kers and such. It was a horrible thing to listen to. At last the only sounds were terrible moaning sounds then quite. The guy next to me was running his mouth off to me about how this was not right and what they were doing to him was just not right and I guess they heard him, because when they came out of the cell they came straight to him, and officer Vola grabbed him and hauled him down the hallway to the left and he was never heard from for the rest of the night. I had heard from one of the other prisoners that spent a few weeks there, that he was injured during his stay. I knew that if any challenge or protest was made about what took place, the same would happen to me.

There were two people that witnessed this close up. One was in the cell at the end of the hallway next to where it happened, I could see him at the window in the cell door when the beating was taking place in the hallway. The second was in a holding cell directly across the hall from cell where it took place. I have been in contact with him after his release and is willing to testify to what he saw.

I was placed into the holding cell at the end of the hallway next to the cell in which this took place. After about twenty minutes the person at the doorway (always someone looking out the window in the door) said that medics had come to look at the guy in the cell. Over three hours later, I think, (no clocks in there) we were transferred to another cell and as we passed the cell one guy looked in and reported he was still laying on the floor in a pool of his blood and vomit.
